What to do after a DUI arrest: a checklist

The days after a DUI arrest are stressful and the deadlines are short. This checklist covers what to do first.

  1. Gather your paperwork. Citation, bail or release papers, any suspension notice or temporary permit, and anything about your vehicle.
  2. Find your license deadline. In some states you have only 10 days to request a hearing (see deadlines by state).
  3. Write down what happened while you remember: where you were, what you drank and when, the stop, the tests, and what was said. Keep it private and share it only with your lawyer.
  4. Don't post about it on social media or discuss the details with anyone but your lawyer.
  5. Note your court date and don't miss it.
  6. Talk to a DUI lawyer. Many offer a free consultation. If you can't afford one, ask the court about a public defender.
