Your Texas license hearing deadline
Texas calls it DWI. To get an Administrative License Revocation (ALR) hearing, DPS must receive your written request no later than the 15th day after you receive notice of the suspension (Texas Transportation Code §524.031).

A refusal suspension takes effect on the 40th day after you receive notice (Texas Transportation Code §724.035).
The criminal case
Separately from the license case, the DWI charge goes through court. Penalties depend on your record, your test result, whether there was a crash and other facts. A local DWI attorney can tell you what's realistic in your court and whether options like a reduced charge or a diversion program are available.
